What should be done to place advertising in open areas?

Entrepreneurs wishing to place advertising in open areas must apply to the State Advertising Agency and obtain a permit. This can be done through ADRA’s online Permit System by visiting the official website is.adra.gov.az and using Digital Login.

What documents are required to place advertising in open areas?

•    If the advertiser is a legal entity or a branch/representative office of a foreign legal entity, a copy of the extract from the State Register of Legal Entities;
•    If the advertiser is an individual entrepreneur, a copy of the identity card;
•    A copy of the certificate of registration as a taxpayer for the advertiser;
•    A color photomontage of the advertisement, a color photograph (scheme) of the location where the advertisement will be placed, and a site plan;
•    Sketch and dimensions of the advertisement;
•    If advertising goods that require licensing or certification for production (sale), a notarized copy of the relevant license, certificate, or other authorization, issued in accordance with the procedure established by Article 9 of the Law of the Republic of Azerbaijan “On Administrative Procedure”;
•    If the trademark or geographical indication in the advertisement is displayed in a foreign language, a copy of the registration certificate issued by the Intellectual Property Agency of the Republic of Azerbaijan.

Where can one apply if an outdoor advertising structure (billboard, carrier) poses a hazard or if the content is questionable?

Are fines imposed for illegal outdoor advertising?

Placing and publishing advertisements without the required permit documents constitutes a violation under Article 428.7 of the Code of Administrative Offenses (fines for individuals: 300–500 AZN, officials: 1500–2500 AZN, legal entities: 5000–10000 AZN).

What is considered outdoor advertising?

Advertising placed directly or via an advertising carrier on land plots, facades of buildings and structures, rooftops, doors, windows, shopfronts, outdoor equipment, road tunnels, bus stops, or underground passages is considered outdoor advertising.

What is the maximum duration for which the State Advertising Agency can issue a permit for outdoor advertising?

The State Advertising Agency can issue a permit for a maximum of three years.

Are goods displayed in shop windows considered advertising?

No, the goods themselves are not advertising; only the information about them is considered advertising.

A poster stand is a small-sized advertising structure with one or two advertising surfaces, usually providing information about theaters, cinemas, sports, and other mass events. Only information about event sponsors may be additionally displayed.

What is a bracket panel?

A bracket panel is a small-sized advertising structure installed on buildings, lights, or separate poles, with internal illumination. Panels on a single support along one side of the street must be installed at the same distance from the ground and oriented consistently relative to pedestrian traffic.

What is a tent?

A tent is an advertising structure installed on doors and windows of commercial, public catering, household, and other service facilities. It consists of fastening elements, a frame, and an advertising surface made of soft or hard material. Tents can have various shapes without affecting the overall building appearance.

What is an advertising umbrella?

An advertising umbrella is a structure in the shape of an umbrella with advertising displayed, installed in commercial, catering, household, and other service facilities outdoors. The advertising surface area corresponds to the area occupied by the advertisement.

What are bus stop signs?

A bus stop sign is a small-sized advertising structure mounted on the structural elements of public transport waiting areas. The surface size must not exceed 1.3 m in width and 2.1 m in length; the support height should not exceed 60 cm. Internal illumination is required.

What is a billboard?

A billboard is a medium or large-sized advertising structure with internal or external illumination. It consists of a foundation, frame, support, and advertising surface. The number of sides cannot exceed three. One-sided billboards must have a decorative back.

What is a Megaboard?

A megaboard is a large-sized advertising structure with internal and external lighting. It consists of a foundation, frame, support, and advertising surface. The number of sides cannot exceed three. The external dimensions of the advertising surface on one side of a megaboard range from 4.00–6.00 x 8.00–15.00 meters, and the height of the support pole ranges from 8.00–18.00 meters. In the case of a single-sided megaboard, the back side must have a decorative design.

How Should Roof Advertisements on Buildings Be?

Advertising structures placed on the roofs of buildings in the form of letters and logos consist of the advertising surface (letters, symbols, numbers), artistic elements (logos, emblems, etc.), and support elements. These are advertising structures with internal lighting only. The dimensions of these advertising structures are determined based on the height of the building and the length of the facade. What Are Facade Advertisements?

Facade advertisements are advertising structures placed on the facades of commercial, public catering, household, and other service facilities, specifically on the entrance sections and between the windows of the first and second floors. The bottom corner of the structure must be at least 2.00 meters above the ground. The structure must not protrude more than 0.20 meters from the point of attachment to the building, and its area must not exceed 1/10 of the facade of the building or structure on which it is installed.

What is a Brandmauer?

A brandmauer (wall panel) is a large-sized, single-sided advertising structure with external lighting, installed on a wall or surface of a building that has no windows. The dimensions of the wall panel are individually determined based on the architectural design of the building and the size of the wall without windows. The minimum advertising surface area of a wall panel is 9 sq.m. These favorable dimensions make such advertisements more flexible in terms of creativity and scale, providing extensive possibilities. What is a Transparent (Banner)?

A transparent is an advertising structure typically made from soft materials such as fabric, mesh, or synthetic leather, installed between two separate poles or between buildings using fastening devices. The minimum height from ground level must be 6 meters. Transparents cannot be attached to city lighting poles. What is an Advertising Flag?

An advertising flag is a double-sided stationary structure consisting of a base, pole, and fabric. The flag can be installed on its own pole or on buildings. Typically, it displays the logo of an enterprise or organization, or other advertising-related information. The dimensions of the advertising flag are determined individually for each case.

What is an Advertising Column?

An advertising column is an advertising structure with a circular or three external advertising surfaces and internal lighting. The dimensions of the advertising column are determined individually.

Are Advertisements on Payment Terminals Considered Outdoor Advertisements?

Static and digital advertisements displayed on payment terminals are also considered outdoor advertisements.

How Many Advertisements Can One Entity Place on Historical Buildings?

On architectural monuments, no more than one facade advertisement belonging to the same entity is allowed.

For What Purposes Can an Advertising Structure Be Used?

An advertising structure may be used only for the purpose of displaying advertisements.

What Advertisements Can Be Placed on a Poster Stand?

A poster stand is used for displaying information about the repertoire of theaters, cinemas, sports, and other mass events. Advertising materials displayed on poster stands may include information only about the events and their sponsors.

Is It Allowed to Place Advertisements on Balconies?

If it is not possible to place advertisements above the entrances or windows of the basement floor, or if the installed advertisements are not visible from the front, advertisements may be placed on balconies.
If the balcony is made of metal structures or architectural elements, placing advertising structures on its surface is not allowed, except for the handrail area.
For advertisements installed on the handrail, the advertising surface may be up to 0.50 x 0.50 meters, and the distance from ground level to the upper edge must not exceed 1.50 meters. In other cases, the advertisement must be placed centrally and may cover no more than 50% of the total balcony area.
